The status of <strong>telehealth flexibilities<\/strong> continues to evolve, this time for the better, though again only short-term. <\/p>\n\n\n\n<p>On November 12, 2025, Congress temporarily funded the government, extending <strong>Medicare telehealth coverage<\/strong> through January 30, 2026. If you want the recent history of the telehealth waiver, read my previous <a href=\"https:\/\/tewconsulting.com\/dw\/medicare-telehealth-coverage-the-government-shutdown\/\">blog<\/a> post. Congress has yet to codify these <strong>telehealth flexibilities<\/strong> into permanent law. Without action, the waiver expires on January 30, 2026, unless Congress passes long-term legislation making <strong>telemental health<\/strong> flexibilities permanent or temporarily extends them again.<\/p>\n\n\n\n<p>To understand what could happen if Congress doesn&#8217;t make <strong>telehealth flexibilities<\/strong> permanent, read my previous <a href=\"https:\/\/tewconsulting.com\/dw\/medicare-telehealth-coverage-the-government-shutdown\/\">blog<\/a> post on the status of Medicare telehealth.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Permanent Medicare Telehealth Benefits for Mental Health Services<\/strong><\/h2>\n\n\n\n<p>Several conditions for <strong>mental health telehealth coverage<\/strong> under <strong>Medicare<\/strong> are now permanent, regardless of temporary extensions. According to <a href=\"https:\/\/telehealth.org\/blog\/senate-passes-cr-extending-medicare-telehealth-flexibilities-through-january-2026\/\">Telehealth.org<\/a>, the following <strong>telehealth benefits<\/strong> are permanently covered:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Medicare telehealth<\/strong> covers mental health treatment <strong>without geographic restrictions<\/strong><\/li>\n\n\n\n<li><strong>Telemental health clients<\/strong> can receive services in their homes permanently<\/li>\n\n\n\n<li><strong>Audio-only telehealth<\/strong> coverage remains permanent for mental health services when the provider has video capability, but the patient cannot or does not consent to video<\/li>\n\n\n\n<li><strong>Marriage and family therapists<\/strong> and <strong>mental health counselors<\/strong> can permanently serve as Medicare providers for telehealth services<\/li>\n\n\n\n<li><strong>Telehealth reimbursement<\/strong> for behavioral health services delivered in patients&#8217; homes is set at the higher non-facility rate<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Medicare Advantage Plans: Telehealth Coverage for Existing Clients<\/strong><\/h2>\n\n\n\n<p><strong>Medicare Advantage plans<\/strong> must cover everything Original Medicare covers. Federal law (42 CFR \u00a7 422.101) specifies that Advantage plans must cover <strong>telehealth for mental health services<\/strong>.<\/p>\n\n\n\n<p>However, <strong>in-person visit requirements<\/strong> may vary by plan. For accurate <strong>telehealth billing<\/strong> information, contact individual <strong>Medicare Advantage plans<\/strong> for their specific <strong>telehealth policies<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Retroactive Medicare Reimbursement: What the Funding Bill Covers<\/strong><\/h2>\n\n\n\n<p>According to Telehealth.org, the proposed government funding bill doesn&#8217;t mention <strong>retroactive Medicare reimbursement<\/strong> for past telehealth services. However, sections 116-119 of the bill&#8217;s summary do allow the government to make retroactive payments to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Federal employees<\/li>\n\n\n\n<li>States governments<\/li>\n\n\n\n<li>Other necessary expenses.<\/li>\n<\/ul>\n\n\n\n<p>Therefore, providers should not expecmay not get <strong>retroactive reimbursement<\/strong> for <strong>telehealth services<\/strong> provided during the funding gap. Additionally, it remains important to maintain detailed <strong>mental health documentation<\/strong> for all services provided.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Future Uncertainty: What Happens After the January 2026 Deadline<\/strong><\/h2>\n\n\n\n<p>With the extension only through January 30, 2026, <strong>mental health providers<\/strong> face another <strong>telehealth crisis point<\/strong> in less than three months. This creates ongoing uncertainty and frusteration for <strong>telemental health practices<\/strong> and <strong>Medicare billing<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Why This Creates Problems for Providers<\/strong><\/h2>\n\n\n\n<p>This pattern of short-term extensions creates:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Uncertainty for <strong>telemental health practices<\/strong><\/li>\n\n\n\n<li>Planning difficulties for <strong>mental health providers<\/strong><\/li>\n\n\n\n<li>Anxiety about future <strong>Medicare billing<\/strong> requirements<\/li>\n\n\n\n<li>Barriers to patient care continuity<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Telehealth Advocacy and Legislative Action<\/strong> <strong>&#8211; It Matters<\/strong><\/h2>\n\n\n\n<p>The repeated short-term extensions create exhausting uncertainty for <strong>mental health providers<\/strong> and barriers for patients seeking <strong>telemental health care<\/strong>. Multiple bills are pending in Congress, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"\/dw\/CONNECT%20for%20Health%20Act%20(H.R.%204206)\">CONNECT for Health Act (H.R. 4206)<\/a><\/strong><\/li>\n\n\n\n<li><strong><a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/5081\">Telehealth Modernization Act<\/a><\/strong><\/li>\n<\/ul>\n\n\n\n<p>These bills would make <strong>telehealth flexibilities<\/strong> permanent and eliminate the <strong>in-person requirement<\/strong> for <strong>mental health telehealth services<\/strong>.<\/p>\n\n\n\n<p>You can help by writing to your <a href=\"ttps:\/\/www.house.gov\/\">House Representative<\/a> and <a href=\"https:\/\/www.senate.gov\/senators\/index.htm\">Senator<\/a> about the benefits of <strong>permanent telehealth coverage<\/strong>. Organizations like NASW, APA, and the American Telemedicine Association are actively lobbying for these changes in <strong>telehealth policy<\/strong>.<\/p>\n\n\n\n<p><strong>Key Points to Include in Your Advocacy<\/strong><\/p>\n\n\n\n<p>When contacting legislators, mention:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>How <strong>telehealth<\/strong> expands access to <strong>mental health care<\/strong><\/li>\n\n\n\n<li>The burden of repeated short-term extensions<\/li>\n\n\n\n<li>Patient stories showing <strong>telemental health<\/strong> effectiveness<\/li>\n\n\n\n<li>Economic benefits of <strong>telehealth services<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Telehealth<\/strong> <strong>for<\/strong> <strong>Medicaid, Commercial Insurance, and Out-of-Network Providers<\/strong>: <strong>What Applies to Your Practice<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Medicaid Telehealth and Commercial Insurance:<\/strong> The <strong>in-person visit requirement<\/strong> officially applies only to <strong>Medicare telehealth<\/strong>. However, <strong>Medicaid<\/strong> and commercial insurers often follow Medicare&#8217;s lead. Given budget pressures, some insurers may adopt similar restrictions to limit <strong>telehealth reimbursement<\/strong> costs.<\/li>\n\n\n\n<li><strong>Out-of-Network Telehealth Providers:<\/strong> While OON providers aren&#8217;t bound by <strong>Medicare billing requirements<\/strong>, clients may find their insurance company won&#8217;t reimburse them for <strong>telehealth services<\/strong> that don&#8217;t meet the in-person requirement. This could affect whether clients receive reimbursement after paying their <strong>teletherapy provider<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>Recommendation:<\/strong> Check with individual insurance companies, as <strong>telehealth coverage policies<\/strong> may vary by policy and by state.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Actions Mental Health Providers Can Take Now<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Continue providing <strong>telehealth services<\/strong> to <strong>Medicare clients<\/strong> without the in-person requirement<\/li>\n\n\n\n<li>Stay informed about <strong>telehealth regulations<\/strong> and <strong>Medicare compliance<\/strong><\/li>\n\n\n\n<li>Watch for <strong><a href=\"https:\/\/tewconsulting.com\/dw\/blog\/\">Documention Wizard<\/a><\/strong> updates as we approach the <strong>January 30, 2026 telehealth deadline<\/strong><\/li>\n\n\n\n<li>Maintain accurate <strong><a href=\"https:\/\/tewconsulting.com\/dw\/trainings\/\">mental health documentation<\/a><\/strong> for all <strong>telehealth sessions<\/strong><\/li>\n\n\n\n<li>Ensure your <strong>telehealth platform<\/strong> meets HIPAA compliance standards<\/li>\n\n\n\n<li>Join professsional organizations advocating for change<\/li>\n<\/ul>\n\n\n\n<p>Though there is bipartisan support for <strong>telehealth<\/strong> and hope for another extension or elimination of the <strong>in-person visit requirement<\/strong>, nothing is guaranteed.<\/p>\n\n\n\n<p>Healthcare and <strong>mental health organizations<\/strong> are advocating for permanently dropping the <strong>in-person requirement<\/strong>. This milestone would support access to <strong>telemental health care<\/strong>, which is a desperately needed win for <strong>mental health providers<\/strong> and clients alike.
